2. CUSTOMER & TECHNICAL SUPPORT
Our customer service staff is standing by to answer your questions about products and help you select products or solutions that will meet or exceed your expectations. Hours of operations are 8.30am to 5.00pm Easter Standard Time.
3. SHIPPING
We strive to ship all orders the day they are placed. To help us do so, we encourage you to place your orders early in the day. All purchase orders are shipped freight prepaid and billed on the invoice. Selection of method of transportation and carrier will be at our discretion.
If you prefer to nominate your own transportation method, please supply in writing your carrier’s name and account number. In this instance all freight charges will be on your account. Should you nominate a carrier for transportation of your order, delivery of these goods shall be deemed complete and you shall be deemed to have accepted these goods once your carrier has picked up the goods from JLM-Accutek Health Care.
4. PRICES
Products shall be sold at the quoted price or current price list, in effect on the date of receipt of your order less any discounts applicable to your hospital, clinic or practice. Prices are quoted in Australian dollars and exclude tax. Where applicable tax will be added to the invoice. All prices are subject to change without notice.
In the event of a reduction in price, this price reduction shall apply to all orders received but not yet filled. In the event of a price increase, such increases shall apply to all orders received as of the effective date given for the price increase.
5. DELIVERY
JLM-Accutek Health Care may give written notice to you, terminate any agreements, and neither party shall have any right of action or claim for damages. Furthermore JLM-Accutek Health Care shall not be liable to you or to any other person for any loss or damage, whether directly or indirectly caused or arising out of any delay or failure to deliver any goods ordered on the date specified.
6. RETURNS & CREDIT POLICY
We want to guarantee the satisfaction of the customers we serve. Notify us immediately if there is a problem with your order. All claims for shortages or incorrectly sent products must be made within 14 working days after receipt of goods. Request for returns of product/s must be in writing and authorised in advance. After authorisation has been granted and a return goods authorisation (RGA) issued, goods must be returned prepaid with the RGA number in their original and unopened cartons. Goods returned due to customer ordering errors will be subject to a 25% or $60, whichever is greater, re-stocking fee and will not be entitled to a credit for the freight charged on the initial delivery of these goods. Non-stock items, which include products specially ordered in for customers, cannot be returned for credit. An order number for the re-stocking fee will be required when the RGA is issued. No items may be returned 21 days after billing to the customer.
7. TERMS OF PAYMENT
Payment is due upon invoicing and payable within 30 days. Accounts deemed to have an unsatisfactory payment record could be put on a credit hold or on a COD (cash on delivery) basis. Ownership and title to the goods shall not pass to you and shall remain with JLM-Accutek Health Care until such time as the goods have been paid in full.
Payment options are cheque, Electronic Funds Transfer, or by credit card. JLM-Accutek Health Care reserves the right to charge an administrative fee on credit card payments.
8. WARRANTY
All instrumentation supplies are warranted against defects in materials and workmanship for a period of 180 days or as indicated on the packaging. This warranty shall not apply to defects resulting from improper or inadequate use and operation of the products outside the product specification.
Should we receive notice of such defects during the warranty period. JLM-Accutek Health Care shall, at its option, either repair or replace products that prove defective.
If JLM-Accutek Health Care is unable, within a reasonable time, to repair or replace any product to a condition as warranted, the customer shall be entitled to a refund of the purchase price upon return of the product to JLM-Accutek Health Care.
9. FUTURE MODIFICATIONS TO THE GOODS
JLM-Accutek Health Care shall be entitled to make any modifications to any existing or future goods that it thinks necessary or reasonable but without incurring any obligations to make such medications to any goods already sold provided however that the goods as modified shall thereafter be the goods for the purpose of this Agreement and any modification made by JLM-Accutek Health Care pursuant to this paragraph shall not extend any of the warranties or the warranty periods as set forth in the terms of trade.
10. REPRESENTATIONS and WARRANTIES
The parties to this agreement specifically agree that all the terms, conditions, and warranties herein contained shall represent the whole of the agreement as between the parties and furthermore you acknowledge that you do not rely upon any other representation made by Orion Medical or any other persons representing JLM-Accutek Health Care or any other person concerning the merchantability or fitness for purpose of the goods.
11. EXCLUSION OF OTHER WARRANTIES
All other warranties that would otherwise be included by law, whether those warranties are expressed or implied pursuant to general law, or by virtue of any statute, are hereby excluded. The warranties given in this terms of trade are the only warranties given by JLM-Accutek Health Care provided however to the extent to which by any statute (whether State or Federal) there is a warranty which applies to this sales of goods irrespective of the agreement of the parties to exclude the same then, this paragraph shall not be interpreted as purporting to exclude the operations of such warranty or warranties and such warranties shall apply.
12. ACCEPTANCE OF THE TERMS OF TRADE
Once products are ordered, and then received by the customer, this constitutes acceptance of our terms of trade.
In the event the customer returns the goods unopened freight prepaid, within a period of 3 days after receiving the goods, this constitutes non -acceptance of our terms of trade.
